总   则

General Principles

第一条、为了促进我校留学生教育的健康发展，为同学们创造良好的学习、生活环境，根据《中华人民共和国外国人入境出境管理法》、《高等学校接受外国留学生管理规定》、《延边大学学生违纪处分实施细则》，结合我校留学生的实际情况，制定本细则。

1. In order to promote and well develop the education of the foreign students’, create good studying environment, the following details rules and regulation is formulated according to the Republic of China on the Entry and Exit Administration, Provisions of accepting Foreign Students of Higher School, Regulation on Penalties for Foreign Students of Yanbian University in combination with the actual situation of the Foreign students’.

 第二条、本细则适用于在我校学习的各类来华留学生。

2. These specific rules are applied for all Foreign students who study in YBU

 第三条、留学生在校学习期间，无论在校内或校外有违纪行为的，均按照本为了促进我校留学生教育的健康发展给予纪律处分。

3. During the study time in school, the students who disobey the rules in or outside the school will still be treated with the punishments according to this detail rules and regulations

第四条、留学生违反校规校纪，根据情节轻重、认错态度、悔改表现等，给予下列处分：

4. Foreign students who violate the school rules and principles, according to the seriousness of the case, attitude of admit, and repentance, the school will give the punishments as following:

（一）警告；

1) Warning

（二）严重警告；

2) Severe Warning

（三）留校察看；

3) Probation in school

（四）开除学籍或勒令退学。

4) Expulsion

留学生有违反校规校纪的行为，但情节轻微不足以给予上述处分的，给予通报批评，并督促其改正错误。

The students disobey the school rules and principles but the seriousness of the case is not serious though enough to treat with the above punishments will be notified of criticism and will be urged to correct the mistake.

第五条、受处分者，同时受到下列处理：

5. Forfeiters are punished as following at the same time:

（一）取消其当学年度所有评优评奖资格；奖学金留学生（包括孔奖生和交换生）停发一个月及以上奖学金，并按年度评审的有关规定处理。

1) Cancel the qualifications of appraising and awarding of the year, scholarship foreign students (including Confucius Institute Scholarship and exchange students) stop giving the scholarship for one month or more and treat with the regulations of the annual review.

（二）学位的授予按《延边大学学籍管理条例》和《延边大学研究生学籍管理实施细则》的相关规定处理。

2) Awarding the degree is treated with the regulations of the Students Status Management Regulations of YBU and the Implementation of Detail Rules of Postgraduate Status Management Regulations of YBU.

（三）有其他规定的按照相关规定进行处理。

3) Other rules are treated with relevant regulations.

 第六条、违反校纪者，有下列情节之一，可以从轻或免予处分：

6. The students who disobey the rules, are given lighter punishment or be exempted from the school as per following situations.

（一）能主动承认错误，如实交待错误事实，检查认识深刻，有悔改表现的；

1) Can take the initiatives to admit mistakes, explain the facts, shows the profound understanding and repent.

（二）确系他人胁迫的；

2) Be intimidated

（三）能主动检举、揭发他人的违纪行为，积极协助有关部门查处问题的；

3) Take the initiatives to report, expose others’ misconduct and assist the related departments to investigate the problem;

（四）有其他可从轻处分情节的。

4) Others can be punished lightly according to the situation.

第七条违反校纪者，有下列情节之一，应从重处分：

7. Disobey the school principles as the following situation should be given heavier punishment.

（一）违纪后拒不承认错误或包庇他人违纪行为的；

1) Deny the mistake or cover up others’ misconduct.

（二）在调查中翻供、串供或对有关人员打击报复、威胁恫吓的；

2) Withdrawing a confession, confession in collusion or threaten and retaliate to the concerned person;

（三）同时有两种及以上违纪行为的；

3) Two or more violations at the same time;

（四）勾结校外人员作案的；

4) Collude with outsiders to commit a crime;

（五）违纪群体的组织者、指挥者；

5) The organizer and conductor of the group of violation;

（六）有其他应予从重处分情节的。

6) Others should be punished in aggravation according to the situation

 第八条处分违纪学生的权限、程序与管理

8. The Limits of Authority, Procedure and Management of punishing the students violating discipline

（一）给予留学生警告、留校察看处分，由所属学院或留学生管理科提出处理意见，报国际交流合作处分管领导批准后决定。

1) Warning and probation in school are put forward by the Department or Foreign Students Administration and report to the Department of International Exchange and Cooperation and approved by the leader.

（二）给予留学生勒令退学处分和开除学籍处分，由所属学院或留学生管理科提出处理意见，经国际交流合作处分管领导审核，再由国际交流合作处报学校作处理决定，并由学校备案。被勒令退学或开除学籍的留学生，如系中国政府奖学金生，应书面报告国家留学基金委员会，并抄报留学生所属国驻华使领馆。

2) The punishment of expulsion of the foreign students are put forward by the concerned Department of Foreign Students Administration, and through examine of the leader of the Department of International Exchange and Cooperation, then the Department of International Exchange and Cooperation report to the school to handle  and put on records by school.The student, who is expulsed from the Chinese government scholarship, should write a report to the China Scholarship Council and report to the foreign student’s Embassies and Consulates in China of that country.

（三）对于留学生违纪行为，应及时调查清楚，必要时报学校公保卫处调查。在提出处理意见之前，应当听取留学生的陈述和申辩。

3) As for the foreign students’ misconduct, should investigate in time, report to the school’s security office to investigate if needed. Before putting forward the handling suggestions, should listen to the student’s explanation.

（四）留校察看一般以一年为限。受留校察看处分的学生，由留学生管理科负责考察，视其在察看期间的表现，可按期或提前解除处分。

4) The limitation of probation in school is one year. The student who is punished with the probation in school, Foreign Students Administration is responsible to check the behavior during the probation in school time, and it will be punished on time or ahead of time.

（五）被开除学籍或勒令退学者，须在处分决定做出后一周内办理离校、离华手续。对逾期不办者，国际交流合作处应及时告知公安机关注销其居留许可。

5) The student who is expulsed should handle the procedure of leaving school and China in one week after the decision of punishment. As for the person failing to handle the procedure on time, the Department of International Exchange and Cooperation will tell the public security organs to withdraw the residence permit.

（六）处分决定要视情况在学校公布。

6) The decision of punishment will be announced at school according to the situation.

第九条留学生奖励机制

9. Rewards System for Foreign Students

（一）学校为留学生设立“优秀自费留学生奖”。该奖项每年评选一次，颁发证书和奖金。“优秀自费留学生奖”的获奖条件为：（1）遵守各项校规校纪；（2）积极参加学校各项活动；（3）学习成绩优异；（4）无警告或严重警告处分记录；（5）学院推荐。

1)Outstanding Self-Funded Foreign Students Award will be given once a year with certificate and Prize to the students meeting the following requirements: (1) Abide by all the rules and regulations of YBU; (2) Actively participate in school activities; (3)With outstanding academic performance;(4) No record of warning or severe warning; (5)Recommended by relevant college.

（二）学校为留学生设立“优秀毕业留学生奖”。该奖项每年评选一次，颁发证书和奖金。“优秀毕业留学生奖”的获奖条件为：（1）遵守各项校规校纪；（2）积极参加学校各项活动；（3）学习成绩优异；（4）无警告或严重警告处分记录；（5）在校期间，为我校留学生事业做出特殊贡献者；（6）学院推荐。

2) Outstanding Foreign Graduate Award will be given once a year with certificate and Prize to the students meeting the following requirements: (1) Abide by all the rules and regulations of YBU; (2) Actively participate in school activities; (3) With outstanding academic performance; (4) No record of warning or severe warning; (5) Make special contribution to the foreign students cause during study at YBU; (6) Recommended by relevant college.

（三）学校为留学生设立“优秀留学生干部奖”。该奖项每年评选一次，颁发证书和奖金。“优秀在校留学生奖”的获奖条件为：（1）遵守各项校规校纪；（2）积极组织并参与留学生各项活动；（3）学习成绩良好；（4）工作责任心强;（5）担任留学生干部满一学期以上。

3）Outstanding Foreign StudentsCadre Award will be given once a year with certificate and Prize to the foreign students cadres meeting the following requirements: (1) Abide by all the rules and regulations of YBU; (2)Actively organize and participate in foreign students activities; (3)With good academic performance; (4)With a strong sense of responsibilities; (5) Be a foreign student cadre for more than one semester.

Specific provisions

第十条对违反中国法律、法规者，给予以下处分：

10. Students who violate Chinese laws and regulations are given the following sanctions:

（一）触犯中国的法律，被依法追究刑事责任者，给予开除学籍或勒令退学处分。

1) Students who break the law and are investigated for criminal responsibility should be given expulsion from academic status or quitted form the school.

（二）违反中国的法律、法规，被司法或行政机关认定，且造成较坏影响者，视其情节，给予警告及以上处分。

2) Students who violate Chinese laws and regulations, recognized by judicial or administrative authority, and cause a bad influence are given warning or more punishment depending on the situation.

 第十一条违反校规及中国法律法规，应给予以下处分：

11. Students who violate school rules and Chinese laws and regulations shall be given the following sanctions:

（一）签证或居留许可超期者，视其情节，给予警告处分。

1) Students whose visa or residence permit exceeds the time limit shall be given warning depending on the degree.

（二）违反校外住宿管理规定，经批评教育后仍不予改正者，给予警告及以上处分。

2) Students who violate the provisions of off-campus housing and refuse to mend their ways despite of admonition are given warning and more punishment.

（三）违反留学生公寓管理规定，影响他人，不听劝阻者，给予警告处分。

3) Students who disobey Dormitory Supervisory Regulation of foreign students and disturb others and do not listen to dissuade, shall be given warning punishment.

（四）长期拖欠学费、住宿费，催缴后仍无故不缴纳者，给予警告处分，情节严重者，给予开除学籍或勒令退学处分。

4)Students who are failing to pay tuition and accommodation fee over time and still do not pay after asked for payment, shall be given warning; if the situation is serious, they shall be given expulsion from academic status or quitted form the school.

（五）不尊重中国的风俗习惯，品行恶劣、道德败坏者，给予警告及以上处分。

5) Students who do not respect Chinese manners and customs and have bad personality and morality shall be given warning and more punishment.

（六）违反学校的各项管理规定者，给予警告及以上处分。

6) Students who violate all the management regulations of the school shall be given warning and more punishment.

（七）违反学校出勤管理规定者，给予警告及以上处分。
每学期，第一次累计旷课30学时或连续旷课一周者给予警告处分；第二次给予严重警告处分；累计旷课80学时或连续旷课一个月者给予留校察看处分或开除学籍。每学期病假、事假累计不能超过80学时；开除学籍者注销其签证并不予再次注册学籍。

7）Anyone who violates attendance rules shall be given warning or more serious punishment.

Students who have been absent for accumulative 30 credit hours or for continuous 1 week shall be given warning for the first time and given serious warning for second time. Being absent for accumulative 80 credit hours or being absent for continuous 1 month shall be given probation in school or expulsion. Accumulative credit hours of excused absences including sick leave shall not be more than 80 for 1 semester. The ones who are expelled from school cannot get their visas renewed and register at school again.

 第十二条留学生在校内严禁进行传教及宗教聚会等活动，违反者，给予警告及以上处分。

12. Foreign students who are engaged in activities, such as mission and religious gatherings, and have violated rules, shall be given warning and more punishment.

 第十三条　驾驶机动车的学生务必先取得相应的机动车驾驶证，并携带驾驶证到留学生办公室填写机动车驾驶申请表，取得办公室批准后才可驾驶。在校内及学校周边发现违规驾驶机动车的学生，学校将扣押其机动车、通知其家属并给予其警告处分；不听劝阻继续违规驾驶机动车者和违反《中华人民共和国道路交通安全法》酿成事故者，情节严重者给予留校察看及以上处分并承担相应的经济及法律责任。

13. Students who want to drive motor vehicles should get driving license first and take the license to Foreign Students Office to fill out the application form of driving. Only the ones who get permission from Foreign Students Office can drive. Drunk driving and drag racing are strictly prohibited. Motor vehicles will be detained if illegal driving is founded in campus or around school. Students will be given warning and the result will be informed to their parents or guardians. Students who violate PRC Road Traffic Law on State Security causing accident, illegally drive a motor vehicle and do not listen to dissuasion,shall be given probation or more serious punishment and the students should be responsible for all the economic or legal consequences.

 第十四条对打架斗殴者，给予以下处分：

14. Students who affray and dustup shall be given the following punishment:

（一）引发事端或激化矛盾，直接参与打架者，给予警告及以上处分。

A. Students who trigger or intensify contradictions, or directly involve in the fight, shall be given warning and more punishments.

（二）组织、策划他人打架、斗殴，情节严重的，给予留校察看及以上处分。

B. Students who organize and plan others to fight causing serious circumstances shall be kept and inspected and given more punishment.

（三）在打架斗殴过程中致使他人受伤者，视其情节，给予留校察看及以上处分。

C. Students who injured other in fight shall be kept and inspected in school and given more punishment (depending on the degree).

（四）为他人打架提供凶器，给予警告处分；造成伤害者，给予留校察看及以上处分。

D. Students who offer weapon used by criminal shall be given warning; who hurt others shall be kept and inspected and given more punishment.

 第十五条对聚众滋事或进行其他违法违纪活动、破坏校园秩序者，给予警告及以上处分。

5. Students who are involved in mobbing or conduct other violations, destroy the peace and order of the school, shall be given warning and more punishment.

 第十六条以各种手段非法占有他人合法财物，或有其他盗窃、欺骗行为者，视其情节给予下列处分：

16. Students who are involved in the variety of means to illegally usurp the legal property, or have other behavior such as theft, fraud, shall be given the following sanctions depending on the degree:

（一）盗窃公私财物，分别给予以下处分：

A. Theft of public or private property, are given the following sanctions respectively:

（1）一次作案且总价值不满500元者，给予警告处分；

1. Students who commit a crime and the total value they steal is less than 500 yuan shall be warned.

（2）多次作案或总价值在500元及以上或影响较坏、情节恶劣者，给予留校察看及以上处分；

2. Students who commit many crimes and the total value they steal is more than 500 Yuan and the aftermath is severe, shall be kept and inspected in school and given more punishment.0

（3）诈骗、抢夺、敲诈勒索公私财物者比照以上规定从重处理。

3. Students who defraud rob and extort public and private property shall be punished severely.

（二）不当占有遗失物品者，视其情节，给予警告及以上处分。

B. Students who occupy materials that do not belong to him shall be given warning and more punishment.

（三）有提供信息及作案工具等协助作案行为，或有掩盖犯罪事实、窝藏赃款赃物行为的，同案处理。

C. Students who offer information and tools for criminal purpose, or who disguises criminal fact and hiding proceeds of crime shall be punished as criminal.

（四）偷窃公章、保密文件、档案等物品者，视其情节，给予留校察看及以上处分。

D. Students who burgle cachet, availability paper, secret document and archives etc. shall be kept and inspected in school and given more punishment.

（五）伪造、涂改、转借证件或材料，或假冒身份实施欺骗行为者，视情节和后果给予警告及以上处分。

1. Students who forge, alter or lend the documents or materials, or cheat with fake identity, shall be given warning and more punishment (according to degree and aftermath).

 第十七条　故意损坏公私财物者，除按价赔偿损失外，根据损坏财物的价值给予下列处分：

7. Intentionally destroy public or private property, in addition to the AD valorem compensate for the losses, based on the value of the damaged property given to the following sanctions:

（一）损坏价值不足500元者，给予警告处分；

A. If the value that damaged is less than 500 Yuan, warning shall be given.

（二）损坏价值500元及以上者，给予留校察看以上处分；

B. If the value that damaged is more than 500 Yuan, the punishment is not less than probation in school.

（三）情节恶劣，后果严重者，从重处分。

C. If the consequence is severe, punishment shall be given in aggravation.

 第十八条违反消防、用电等相关规定，给予警告及以上处分；因以上行为造成严重后果者，给予开除学籍或勒令退学处分。

18. Students who disobey the provisions of fire, electricity, etc shall be given warning and more punishment; If the above actions have severe consequences, students shall be given expulsion from academic status or school expulsion.

第十九条发表或散布反对、攻击其他国家的言论，有损他人正当利益的，视情节给予警告及以上处分。

19. Students who publish or make comments against other countries and damage the benefits of others shall be given warning and more punishment (depending on the degree).

 第二十条违反公共道德者，视其情节，给予警告及以上处分。

20. Students who violate public morality shall be given warning and more punishment.

 第二十一条以各种方式组织或参与赌博者，除没收其赌具和赌资外，视其情节，给予留校察看及以上处分。

21. Students who organize or participate in gambling in various ways shall be given disciplinary probation, more punishment and confiscate their gambling devices and funds (depending on the degree).

 第二十二条本细则没有列举的违纪行为，可参照有关规定的相关条款给予处分。

22. If there are prohibited behaviors that are not listed in this specific punishment regulation, then the relevant regulations can be referred to give punishment.

 附则

Supplementary Articles

第二十二条本细则由国际交流合作处负责解释。
